Media Release: Privacy law for the private sector

"From 21 December 2001, all Australians will have new rights to privacy" said the Privacy Commissioner, Malcolm Crompton. "The commencement of the private sector amendment to the Privacy Act 1988 marks a new era of privacy protection for all of us.

"For the first time, many private sector organisations will be required to make sure individuals understand what will happen to their information, and how they can access and correct their records. Australians have had these rights when dealing with federal government agencies since 1988 when the Privacy Act 1988 came into effect," he said.

"I encourage organisations not just to see privacy as a compliance issue, but as a way of enhancing good relationships with their clients and customers," said the Commissioner.

Media Release: Privacy Commissioner welcomes Genetic Testing & Information Issues Paper (14/11/2001)

"The ALRC and AHEC have worked with key stakeholders to deliver a considered and thorough Issues Paper that will encourage broad and informed discussion of this very important issue" said the Commissioner.

"Protection of genetic information is crucial to the privacy of Australians, and I encourage all interested parties to read the document and participate in the consultation process" said Mr Crompton.

Announcement: Commissioner involved with consultative group on protecting children's privacy, (21/6/2001)

On the 4th June 2001, the Attorney General announced that a consultative group of people with experience in a range of areas affecting children will meet for the first time next month to review existing Commonwealth privacy laws. The  Privacy Commissioner will participate in this consultative group which will consider whether there is a need for more specific protection of children's personal information. Announcement: A Summary and Some Key Issues for Comment: Draft Guidelines on the National Privacy Principles (15/6/01)

We want to hear from you!

We know that some people have limited time and resources or maybe an interest in only one or two aspects of privacy and may not wish to read the whole of the National Privacy Principle (NPP) Draft Guidelines. We've developed a Summary of the NPP Draft Guidelines to assist you in providing us with your feedback. Please note: comments required by 6/7/2001.

Announcement: Revised Credit Reporting Advice Summaries (18/4/2001)

In February 2001, the Privacy Commissioner released, for public consultation, three revised Credit Reporting Advice Summaries dealing with:

  • the relisting of default entries that have been removed because the requirements of the Act were not met initially - this replaces existing summary 9.3;
  • the recording of top-up loans with credit reporting agencies - a new advice 9.6.1; and
  • the Privacy Act's distinction between 'mortgage insurers' and 'trade insurers', which differs from usual industry usage - a new advice 10.32.1.

Relatively little feedback was received and these revised advices have now been finalised with the wording unchanged from the consultation versions.

Announcement: Review of the Privacy Commissioner's Credit Advice Summaries (February 2001)

Since the credit advice summaries were first issued, developments in the credit industry have generated a number of new issues in the interpretation of the credit reporting provisions in Part IIIA of the Privacy Act. As well, some of the existing advice summaries are in need of revision. As a first step in reviewing the summaries, the Office of the Privacy Commissioner has prepared three new advice summaries for public comment before finalisation.

Announcement: New Privacy Advisory Committee members appointed (January 2001)

"I am pleased that new members have been appointed to the Privacy Advisory Committee (PAC), by the Attorney-General on 22/12/2000, and am eager to establish positive working relationships with them," said Privacy Commissioner Malcolm Crompton.

"Now that the Privacy Amendment (Private Sector) Bill has become law, I look forward to working with the PAC to establish an Australian culture that respects privacy.

"During the next 12 months my Office will be consulting with business and the community to develop guidelines to help organisations meet the requirements of the new privacy law. I'm sure that the PAC will play a vital role in that process.

"I'd like to congratulate the members on their appointment to the Committee," Mr Crompton said.

The new members are:

  • Ms Karen Curtis, Director of Industry Policy, Australian Chamber of Commerce and Industry
  • Mrs Margaret Smith AO, the Immediate Past President of the Country Women's Association of Australia
  • Mr Graeme Innes AM, Deputy Discrimination Commissioner, Human Rights and Equal Opportunity Commission
  • Mr Peter Ford, Head of the Information and Security Law Division, Attorney-General's Department

Existing member:

  • Mr Peter Upton, Director, Federation of Automotive Products Manufacturers
