History leading to Temporary Public Interest Determinations 2002-1 and 2002-1A

In December 2001 the Federal Privacy Commissioner received an application for a public interest determination under section 73 of the Privacy Act 1988 from the Australian Government Employees Superannuation Trust (AGEST) in relation to its use and disclosure of the Australian Government Service Number (AGS number) for superannuation purposes.

Since the application raised issues of an urgent nature, the Federal Privacy Commissioner issued Temporary Public Interest Determination (TPID) No. 2001-2 under section 80A of the Privacy Act and a determination under section 80B(3) giving general effect to TPID 2001-2 in December 2001.

The matters raised in the application are still under consideration and the Federal Privacy Commissioner has now issued two further Determinations ? TPID 2002-1 under section 80A and TPID 2002-1A under section 80B(3) giving general effect to TPID No. 2002-1. As a consequence, the use and disclosure of the AGS number by AGEST or any organisation in the course of managing, processing and allocating superannuation contributions remitted by Commonwealth and ACT agencies and departments to their employees' superannuation funds does not breach the National Privacy Principles. These temporary Determinations expire on 21 December 2003.

The Federal Privacy Commissioner will further consider AGEST?s application for a Public Interest Determination, in accordance with Part VI of the Privacy Act.
