I think that a real estate agent* or residential tenancy database operator has recorded incorrect information about me. What can I do?
Real estate agents covered by the Privacy Act, and all residential tenancy database operators, must take reasonable steps to keep the personal information they hold accurate, complete and up-to-date.
You can ask to have information corrected if you think it is not right. To do this, you will have to show that the information the real estate agent holds about you is not accurate, complete and up-to-date.
If the real estate agent disagrees with you about the information, you can ask them to attach a note to the record that says you believe that the information is not accurate, complete or up-to-date.
You can also make a complaint to our Office if you are not happy with the way the real estate agent handles your request.
Your state or territory Fair Trading / Consumer Affairs office, tenants' organisation or Real Estate Institute may also be able to help you (FAQ 9).
